Enterprise & Regulatory Reform Act
The Enterprise & Regulatory Reform Act has come into effect and many believe that the regulations will make the UK a better place for employers.
However it is Section 69 of the Act where current concern lies as some state they provide less protection for employees in regards to civil claims. Section 69 puts the onus on the employees to prove the company/employer was negligent. Employees must prove that reasonable steps were not taken by the employer instead of the employer proving they did all that was practicable.
Solicitors are stating that this will make the claims process harder for employees and believe this will deter many employees from making such claims against their employers.
